Acceptance of Order

 

All purchase orders must be confirmed in writing from the buyer to the seller.

Prices
All prices quoted are ex works and are subject to VAT at the time of invoice.

Payment
Payment is due within 30 days from date of invoice unless otherwise specified.  The Seller reserves the right to charge interest at 3% per month on overdue accounts.  Payment shall be in £ sterling, and remittances, transfers and orders shall be at the Buyer’s expense.

Title of Ownership
Title of ownership shall not pass to the buyer until the seller has received payment in full.

Delivery
All carriage costs and risk of freight damage are the obligation of the Buyer.  The Seller will make every reasonable effort to see that delivery promises are fulfilled.  However, if we are unable to meet scheduled delivery dates due to factors beyond our control, such as fires, strikes, government directives, or failure of our suppliers to meet their promises, shall not be liable for consequential or special damages.  Should any material shipped ex-works be received damaged, it is the Buyer’s responsibility to enter a claim with the freight company.

Cancellation
In the event of order cancellation from the Buyer for any reason whatsoever the seller reserves the right to charge for any expenses incurred as a result of such cancellation.

Claims
Any claims for shortages, price discrepancies, damage or erroneous equipment supplied, must be made within 3 days from receipt of goods, after which no such claims will be accepted.

Warranty
The Seller warrants its equipment, under normal use, to be free of defects in materials and workmanship for a period of 12 months from date of invoice The Seller will either repair or replace defective equipment free of charge, at its sole discretion, provided the equipment is returned carriage prepaid to the premises of AM Industrial (UK) Ltd.

The Seller will endeavour to supply spare parts whenever possible for the length of the warranty.  Thereafter, repairs will be made at the Seller’s established prices.  Unauthorised service or repairs by an agency or person other than authorised AM Industrial (UK) Ltd. Personnel, renders the warranty void, releasing the Seller from further responsibility or obligation.  The Seller will not be responsible for failures caused by improper storage, misuse (including failure to provide reasonable and necessary maintenance), accident, lightning discharge, or malfunctions when products have been modified or operated in excess of rated power, altered, service or installed in other than a workmanlike manner.  Any damage caused by failure to observe proper procedures of installation, operation and maintenance of the equipment will not be covered by this warranty.  This is the only warranty the Seller makes.  All other warranties expressed or implied, are disclaimed.  No one is authorised to assume any liability with the sale of goods except as stated herein.  In no event will the Seller be responsible for indirect or consequential damages.

Warranty Exceptions

General

There is no warranty on consumable items and parts where usage-induced wear may occur.

Light Heads
There is no warranty on lamps whether fixed individually or in encapsulated clusters.

Camera Control Cable
The cable is warranted against any manufacturing defects. General wear and tear through normal use and cable reterminations do not form part of the Company’s warranty.

Health & Safety at Work Etc. Act 1974
In compliance with section 6 of this act, the Seller confirms that the goods supplied do not represent a hazard to health and safety when properly used.
